Appellate

Lama v. Preskill, 353 Ill.App.3d 300 (2004)

Patient voluntarily injected into medical malpractice case issue whether she knew or should have known of injury from allegedly negligent surgery prior to expiration of two-year limitations period governing medical malpractice action, and thus, waived attorney-client privilege with respect to communications between patient’s husband and medical malpractice attorney following surgery and while patient was still hospitalized that were relevant to resolving limitations issue, where patient alleged in complaint that limitations period was tolled until alleged date she discovered injury.
