Suarez v. W. M. Barr

Mr. Scanlan represented the plaintiff, Juan Suarez, who was severely burned during his application of a paint remover in his basement. The District Court entered summary judgment, and plaintiff appealed. The appeal dealt with the Federal Hazardous Substances Act, 15 U.S.C. Sec. 1261(f)(1)(A)-(B) and the application of the Illinois risk-utility test. The Seventh Circuit Court of Appeals reversed the District Court’s granting the defendant summary judgment and remanded the case back to the District Court for trial.
